Rep. Anna Paulina Luna (R-Fla.) said that a measure to extend the Foreign Intelligence Surveillance Act’s (FISA) warrantless spy powers is dead unless the Safeguard American Voter Eligibility (SAVE) America Act is attached to it.
“I think FISA dies unless SAVE America is attached. Period,” Luna told The Hill in an interview on Monday.
The SAVE America Act is a GOP-backed bill that would require proof of citizenship to register to vote in federal elections and the presentation of an ID to cast a ballot. The House passed the bill back in February, but Senate Democrats have said they wouldn’t provide the votes necessary for the bill to overcome a filibuster and advance in the upper chamber.
Luna is looking to leverage the renewal of Section 702 of FISA, which allows the government to spy on foreigners abroad without a warrant, as a vehicle to advance the SAVE America Act and potentially pressure the Senate.
President Trump and Speaker Mike Johnson (R-La.), meanwhile, have been pushing for a clean 18-month extension of Section 702. Trump urged House Republicans to unify around the measure on Tuesday.
“I am asking Republicans to UNIFY, and vote together on the test vote to bring a clean Bill to the floor. We need to stick together when this Bill comes before the House Rules Committee today to keep it CLEAN!” he said of an upcoming vote to bring the bill to the floor.
Johnson also told reporters on Tuesday that, “It’s going to be a clean extension, and if we put amendments on it, it jeopardizes its passage, and it’s far too important.”
The House Rules Committee is set to take up the measure Tuesday, but its path to passage remains uncertain, as several House Republicans have already signaled they would oppose an extension of Section 702. Johnson would need near-unanimous support from Republicans on a procedural rule vote to tee up the bill for debate and a final vote.
Rep. Eric Burlison (R-Mo.), a member of the group, told The Hill last month that a clean vote on FISA is “ignoring the fact that my constituents and their constitutional rights are being trampled on pretty much everyday by our intelligence community through FISA.”
Rep. Tim Burchett (R-Tenn.) voiced similar sentiments in March, saying that he’s got “a lot of concerns” about FISA and doesn’t like the government “spying on American citizens.”
