The NAACP’s lawsuit seeks to halt the use of unpermitted natural gas turbines at xAI’s 'Colossus 2' facility in Southaven, Mississippi, citing significant public health risks and violations of the Clean Air Act. The DOJ, however, contends that shutting down these turbines would disrupt critical AI infrastructure that supports Department of Defense operations.

At the heart of the government’s argument is the role of xAI’s 'Grok' model, which the Department of Defense utilizes for mission-critical tasks across classified networks.
