President Trump in a filing on Monday moved to dismiss his $10 billion lawsuit against the IRS over an agency contractor who leaked his tax return information to news outlets.

The notice of voluntary dismissal was filed in a federal court in Miami.

Trump’s civil lawsuit sought an 11-figure payout on taxpayers’ dime, pointing to a federal law that enables Americans to seek damages from the federal government for breaches of their sensitive taxpayer information.

The president, alongside his two oldest sons, Eric Trump and Donald Trump Jr., and the Trump Organization, sued the IRS and the Treasury Department.

In an April order, District Judge Kathleen Williams said both parties in the case were working to resolve it.

However, Williams raised concerns at the time about President Trump serving as both a plaintiff and defendant in the case.

“Although President Trump avers that he is bringing this lawsuit in his personal capacity, he is the sitting president and his named adversaries are entities whose decisions are subject to his direction,” Williams wrote.

“It is unclear to this Court whether the Parties are sufficiently adverse to each other so as to satisfy [the Constitution’s] case or controversy requirement,” she added.
